Minutes July 06

Minutes of a Meeting of the Bracebridge Heath Parish Council held on Tuesday 4th July 2006 held in the Village Hall at 7.15pm

Public Forum

Police
PC Annall sent his apologies, as he was unable to attend the meeting; the Clerk read from a report detailing crimes reported in the preceding month.

County Council
County Councillor Mrs C Talbot updated Council on County Council matters; County Councillor Mrs Talbot was aware of the correspondence from Cllr Mrs Manders regarding the Section 106 Agreement for the development of the former St John’s Hospital, County Councillor Mrs Talbot expressed disappointment that NKDC policy is now to develop social housing with no contribution made for infrastructure.
Congratulations on the successful opening event for the new bowling green on 20th May 2006 which County Councillor Mrs Talbot was pleased to attend and apologies for being unable to attend the Gala Day.
The leader of the County Council Councillor Hill attended a meeting on 27th June 2006 with Waddington Parish Council and members of the community regarding the Lincoln Southern Bypass at which it was promised that further investigation would take place into Corridor 3 however no promises were made that the route would be changed.
Members advised that the gullies in front of Sleaford Road cottages have been cleaned however two sections are loose and there is also damage to the gullies in front of the
Co-op store adjacent to the exit to the car park. County Councillor Mrs Talbot would take this to the Highways Department for attention
County Councillor Mrs Talbot raised concern regarding the ongoing problems with Bracebridge Heath Youth Club and offered assistance if required; Cllr Spencer would contact County Councillor Mrs Talbot if any assistance is required.

District Council

District Councillor Gallagher gave apologies from District Councillor Mrs Hubbard, the problems with the bushes on Davy’s Lane has been reported to Nina Camm for investigation. District Councillor Gallagher updated the Council with the activities and successes of the Anti-Social Behaviour Team in relation to Bracebridge Heath. Section 106 Policy, District Councillor Gallagher reiterated that NKDC Section 106 Policy covers the whole of the District and not only the development at Bracebridge Heath.

Norwich Drive & Bath Road – A resident reported to Council problems with speeding cars in both Bath Road and Norwich Drive and enquired as to the possibility of speed retarders being constructed. The Chairman responded that this was a matter for LCC Highways however the Council would write to request that the situation is looked at, the Clerk would also provide the residents with details of contacts at LCC Highways and urged residents to also write to outline the problems being experienced.

96/2006: Declarations of interest in items on the agenda

Cllr M Spencer declared a personal interest in the request for additional street lighting on Redhall Lane.
Cllr Mrs S Manders declared a prejudicial interest in copy correspondence relating to the Governors of St John’s Primary School

97/2006: Minutes of Previous Meeting held 6th June 2006

Council received the Minutes of the meeting held on 6th June 2006; it was proposed and seconded that the minutes be approved as a true record.
Vote: Unanimous
Resolved: That the Minutes of the meeting held on 6th June 2006 be approved as a correct record and signed by the Chairman

98/2006: Report by Clerk to Council on ongoing matters

Section 106 Agreement St John’s Park – Correspondence and relevant minutes have been forwarded to Langleys Solicitors for
review and advice. Peter Horner of Langleys Solicitors has requested additional information and continues to look into the matter. – Reply has now been received the matter placed on the Agenda for the July Meeting. It was requested the matter be discussed in Private Session

Youth Club – The model constitution has been forwarded to Bracebridge Heath Youth Club no further correspondence has been received.

Anti – Social Behaviour – Contract has been placed for the locking of the Recreation Ground commencing on 1st May 2006,
some initial problems were encountered these now appear to have been resolved as no further complaints have been received.
Gates have been ordered for the Grantham Road Play Area. Ongoing

Parking on Davy’s Lane – Petition has been forwarded to Lincolnshire County Council will be discussed at the Lincolnshire
County Council Planning and Regulation Committee scheduled for 17th July 2006

Litter Bins – The order has been placed for the replacement litter bins. Awaiting delivery

LALC – Reorganisation of Local Government - response is awaited from LALC regarding the next stage of the process. A meeting was held on 29th June 06 regarding this issue. The County Secretary, Richard Enderby, will shortly circulate a report on the meeting on receipt this report will be copied and circulated to all Members.

99/2006: Report by Parish Council Representative on Gala Day 2006

Cllr Rawson MBE gave a report on the successful Gala Day recently held and gave thanks to all the Gala Day Committee for their hard work in particular Mr Alan Clark. However if the Gala Days are to continue the Committee require as a necessity additional help and support. The work currently falls on a small number of volunteers however this situation is not sustainable and without further offers of assistance future Galas are in danger of not being able to be organised.

100/2006: Request for Additional Street Lighting – Redhall Lane

A resident request for the installation of a further street light on Redhall lane was referred to this meeting from the April Council meeting the request and correspondence was circulated prior to the meeting. Following further discussion on the matter it was proposed and seconded that a further street light is not installed on Redhall Lane. It was further proposed and seconded that a street light is installed on Redhall Lane,

Vote for the proposal to install an additional light: two votes for the proposal.
Vote for the proposal not to install the additional light: six votes for the proposal, two votes against the proposal, and two abstentions.
Resolved: That an additional street light would not be installed on Redhall Lane.

It was agreed that if in the future there was any material difference in the information presented to Council regarding this matter, the matter could be re-assessed. The Handyman would be asked to trim the branches around the existing light.

101/2006: Correspondence from Langleys Solicitors regarding Section 106 Obligation, St John’s Park

It was proposed and seconded that the matter be discussed in Private Session
Vote: Unanimous

Cllr Mrs S Manders reported on a meeting of the Planning, Lighting & Roads Committee held prior to the Full Council meting on 4th July 2006.

Cllr Ward reported that no meeting of the Recreation Ground Committee had been held.

105/2006: Summer Recess and Date of Next Meeting

It was proposed and seconded that there would be no Council Meeting in August. Any matters which require action would be considered by a meeting of the Chairman, Vice Chairman and Chairmen of Committees, having Executive Powers. Date of the next meeting to be 5th September 2006.

106/2006: Items for the Agenda for the Council meeting of 5th September 2006

The following items were requested to be included on the agenda for the next Council meeting to be held on 5th September 2006; Reports from the Parish Council Representatives to the Gala Day Committee and Youth Club, Roadcar bus services and to confirm the arrangements from Remembrance Sunday Service.

107/2006: Exempt Information

Vote: Unanimous
Resolved: That, under Section 100(A)(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the consideration on minute no 108/2006 on the grounds that it involves the likely disclosure of exempt information, as defined in the relevant paragraphs of Part 1 of Schedule 12A of the Act.

108/2006: Correspondence from Langleys Solicitors regarding Section 106 Obligation, St John’s Park

Langleys Solicitors had prepared a draft response to NKDC regarding the Section 106 Agreement for St John’s Park in respect of interest payable on the sum of monies held by NKDC. It was proposed that the letter be sent to NKDC for the attention of the Chief Executive Officer by the Solicitor, the Solicitor to correspond with the District Council on this matter.

Resolved: That the response letter prepared on behalf on the Council be sent to NKDC for the attention of the Chief Executive Officer by the Solicitor, the Solicitor to correspond with the District Council on this matter.

There being no other business the Chairman declared the meeting closed at 8.50pm
